Punchbowl, LLC (“Company”, “we”, or “us”) is committed to protecting your privacy and providing you with the most powerful and safe online experience. This Privacy Policy (“Policy”) applies to you, as an individual, when you use our Modern Stamp service, the Modern Stamp website located at https://www.modernstamp.com (“Site”), related mobile or web-based applications (the “Apps”), and the associated services, data, information, tools, functionality, updates and similar materials (collectively, our “Services”). This publication intends to help you understand how personal information you provide to us is collected and used, so you can make informed decisions when using our Services.
By using the Services, you consent to the data practices described in this statement. Notices of all changes that materially affect ways that your personally identifiable information may be used or shared will be posted in updates to our privacy policy. Please also refer to our Terms and Conditions, available here, which are incorporated as if fully recited herein. Terms defined in the Terms and Conditions that are not defined herein shall have the same definition as in the Terms and Conditions. If you continue to use the Services, or other means of legal consent, after these notices of changes have been posted to the site, you hereby provide your consent to the changed practices.

1. Personal Information We Collect
In order to use the Services, you must first register for an account. During this registration process you are required to provide personally identifiable information, such as your e-mail address and name. Once you are a member you may provide additional information for your member profile such as home address, zip code, interests, and favorites. Providing additional information beyond what is required at registration is optional, but will allow you to better identify yourself and find services that we offer.
We do not solicit, or knowingly collect and store personal information from anyone under the age of 16. We will immediately remove and delete any and all information from anyone under 16 if notification is provided that a person under 16 registered for the Services. If you have a reason to believe information was collected about a child under 16, please contact privacy@modernstamp.com.
We automatically collect information about your computer hardware and software. This information can include: your IP address, browser type, domain names, access times, pages visited, features used and referring Web site addresses. This information is used by the Company to improve the operation of the service, to maintain quality of the service, and to provide general statistics regarding your use of the Services.
If you directly disclose personally identifiable information or sensitive information through a message or other public forum within the Services, this information may be collected and used by others. We do not read any of your private online communications.
We encourage you to review the privacy statements of websites you choose to visit through links appearing on our Services so that you can understand how those websites collect, use, and share your information. The Company is not responsible for the actions of, privacy statements or other content on websites outside of the Site and any other websites owned by Punchbowl, LLC, even if their link appears on one of our pages.
2. How We Use Your Personal Information
The Company collects and uses your personal information to operate and deliver the services you have requested. When you register with the Services, you are automatically enrolled in our marketing emails. These marketing emails have information about new features and useful tips about using the website. If you do not wish to receive these marketing emails, simply unsubscribe from the bottom of any email. You can quickly and easily unsubscribe by clicking the "Unsubscribe" links in the email. When you unsubscribe, you will no longer receive the marketing emails. However, you will continue to receive administrative emails that are related to your usage of the Services. We also use your personally identifiable information to inform you of other products or services available from Punchbowl, LLC and its affiliated companies. We may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered. We will communicate with you through emails and messages posted on the Service.
We may, from time to time, contact you on behalf of carefully selected business partners about a particular offering that we believe may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, zip code) is not transferred to the third party. In addition, we may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services. Both the Company and its trusted partners are required to maintain the confidentiality of your information. Personal data collected through the short code/SMS program won’t be shared, sold, or rented to unaffiliated or affiliated third parties for their own marketing purposes.
From time to time, we may enter into strategic partnerships in which your personally identifiable information may be provided to a carefully selected business partner. These strategic partnerships may include private-label, co-branded websites, or other promotional web pages for which we may receive financial compensation. Any strategic partners to whom we disclose personal information may have their own privacy policies, which describe how they use and disclose personal information. Those policies will govern use, handling and disclosure of your personal information once we have shared it with those strategic partners as described in this Privacy Policy.
The Company keeps track of the websites and pages our customers visit on ModernStamp.com and within the Punchbowl family of companies, in order to determine what services are the most popular. This data is used to deliver customized content to customers whose behavior indicates that they are interested in a particular subject area.
The Company uses Google APIs on ModernStamp.com, and our use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.
Notwithstanding any other provision, we may allow third parties to monitor Site activity using cookies, web beacons and similar technologies for the purpose of reporting website traffic, statistics, targeted advertisements, “click-throughs” and/or other activities.
We will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on the Company or the Site; (b) protect and defend our rights or property; and, (c) act under exigent circumstances to protect the personal safety of users of the Services, or the public.
3. Use of Cookies
Like most websites, our Site uses "cookies" to allow you to bypass the login screen ("Remember Me" functionality). A cookie is a tiny data file, which resides on your computer and allows us to recognize you as a member when you return to the Services from the same computer and browser. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.
One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, when you register with the Services, a cookie helps us to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the Services, the information you previously provided can be retrieved.
You have the ability to accept or decline cookies. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the features of the Modern Stamp services.
Our Service may use Google Analytics, a web analytics service provided by Google LLC ("Google"). You may be able to opt-out of some or all of Google Analytics features by downloading the Google Analytics opt-out browser add-on, available at, https://tools.google.com/dlpage/gaoptout. You may be able to opt-out of Google's collection and/or use of your information. 4. Text Message and SMS Marketing
If you choose, you can provide your mobile phone number to receive text message alerts from us, Vendors or other Users to communicate generally, receive promotions, product announcements, and other marketing information from us. You agree, that by providing your mobile phone number, you expressly consent to receive automated text and SMS marketing messages from us to the mobile phone number that you provide. We may send you these messages from time to time, on a recurring basis, as promotions, announcements, and other marketing information become available. We do not have any control over the number of messages that you may receive from Vendors or other users. Opting-in or providing your consent to receive these messages is not required in order for you to use the Service generally.
We may share your mobile phone number with service providers with whom we contract to assist us with the above activities, but we will not share your mobile phone number with third parties for their own marketing purposes without your consent. Text Messages are distributed via third party mobile network providers and, therefore, we cannot control certain factors relating to message delivery. Depending on your mobile carrier, it may not be possible to transmit the text message to you successfully; nor is content available on all carriers. We do not claim or guarantee availability or performance of this service, including liability for transmission delays or message failures.
At any time, you can opt-out of receiving these messages by replying “STOP” to any such message that we send you.

5. Security of Your Personal Information
After receiving your personal information, we will store it on our servers for future use. We have physical, electronic, and managerial procedures in place to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect including, but not limited to, strong encryption, firewall protection, secure socket layer (SSL) protocol (for transfers), and industry best practice authentication. Unfortunately, no data transmission over the internet or data storage solution can ever be completely secure. As a result, although we take industry-standard steps to protect your information, we cannot ensure or warrant the security of any information you transmit to or receive from us or that we store on our or our service providers' systems.
6. How You Can Control Your Personal Information
You may choose to restrict the collection or use of your personal information in the following ways:
If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by writing to or emailing us at privacy@modernstamp.com.
If you wish to unsubscribe from receiving marketing emails, please click the unsubscribe link included in the footer of all of our emails.
If you believe that any information that we are holding about you is incorrect or incomplete, please email at privacy@modernstamp.com. We will promptly correct any information found to be incorrect. You may also request that we delete the information we have collected about you at any time by emailing us at privacy@modernstamp.com. Please note that in certain circumstances, we may not be able to completely remove your information from our systems. For example, we may retain your information for legitimate business purposes, if it may be necessary to prevent fraud or future abuse, for account recovery purposes, if required by law or as retained in our data backup systems or cached or archived pages, or where the burden or expense of accommodating your request would, in our good faith judgment, be disproportionate to the risks to your privacy, or where the rights of others may be violated. All retained personal information will continue to be subject to the terms of the Privacy Policy to which the User has previously agreed.

7. California Privacy Notice
Under the California Consumer Privacy Act (“CCPA”), California residents have certain rights regarding the Personal Information that we collect:
  • The right to know the categories of personal information collected and how we use and disclose that personal information (see table below).
  • The right to access or delete certain pieces of personal information.
  • The right to correct any incorrect, incomplete, or outdated pieces of personal information.
  • The right to ask us to transfer their data to another provider of the services that the Company provides.
  • The right to opt-out of the selling or sharing of your personal information.
  • The right to limit the use and disclosure of your sensitive personal information.
  • The right to be free from automated decision-making.
  • The right to not be discriminated against for exercising your other rights.

There is not yet a consensus as to whether third-party cookies and tracking devices associated with our websites and mobile apps may constitute a “sale” of your personal information as defined by the CCPA, that being said, to the extent your information is being tracked by cookies across unaffiliated websites and services, this constitutes “sharing” under the CCPA. You can exercise control over browser-based cookies by adjusting the settings on your browser. Further, you can learn more about your choices regarding certain kinds of online interest-based advertising with the Digital Advertising Alliance or the Network Advertising Initiative. We do not represent that these third-party tools, programs or statements are complete or accurate.
Some web browsers include the ability to transmit “Do Not Track” signals, which is a privacy preference that users can set to opt out of tracking by websites and online services. Punchbowl does not process or respond to “Do Not Track” signals.
California residents can make the following requests regarding their personal information:
When you exercise these rights and submit a request to us, we may ask for your email address and/or require additional verification. We also may use a third-party verification provider to verify your identity. We will check our systems for the email address that you provide, and any information associated with such email address. If you provide us with an email address that has not been used to interact with us, then we will not be able to verify your identity. In other words, the only reasonable method by which we may verify the identity of individuals is if we have an email address on file that was provided to us in relation to our services.
You may submit a request to exercise your rights under the CCPA through an authorized agent. If you do so, the agent must present signed written permission to act on your behalf and you may also be required to independently verify your identity with us.
8. State Privacy Notices
In addition to the rights described above under the CCPA, there are privacy laws for in Colorado, Connecticut, Virginia, Texas (on or after July 1, 2024), and Utah that provide certain rights to the residents of those States with respect to their personal data. Those rights include:
  • The right to access or delete certain pieces of personal information (which may also apply to information not obtained from the User/resident themselves).
  • The right to opt-out of the sale of your personal information (which may only apply to personal information ‘sold’ for money), targeted advertising, and processing for the purpose of profiling (to make an automated decision or produce legal/significant effects for the User/resident).
  • Opt-in/consent to our processing of sensitive personal information, including, but not limited to your geolocation data.
  • And if a resident of CO, CT, TX, or VA, the right to appeal a decision by the Company to deny a request to exercise by a User to exercise their rights under the applicable State law. If we deny your appeal, you may submit a complaint to the respective Attorneys General of the States mentioned in the previous sentence.
Residents of Colorado, Connecticut, Virginia, Texas, and Utah can make the following requests regarding their personal information:
When you exercise these rights and submit a request to us, we may ask for your email address and/or require additional verification. We also may use a third-party verification provider to verify your identity. We will check our systems for the email address you provide, and any information associated with your email address. If you provide us with an email address that has not been used to interact with us, then we will not be able to verify your identity. In other words, the only reasonable method by which we may verify the identity of individuals is if we have an email address on file that was provided to us in relation to our services.
9. Nevada Residents
If you are a Nevada resident, you have to the right to opt-out of the “sale” of your “covered information” as such terms are defined in Chapter 603A of the Nevada Revised Statutes (“Nevada Privacy Law” or “NPL”). For the avoidance of doubt, we do not “sell” your “covered information”. As someone that is subject to the NPL, you have the right to be informed about what personal information we are processing, why, and who else your data may be passed to. For more information, please see the chart in Section 6 above, specifically the portions regarding what categories are collected, sold, and disclosed. Please note that defined terms may vary among different state laws, and that the NPL definitions of certain terms apply to this Section 8, and your reading of Section 6 in reference to this Section.
10. International Users
This Privacy Policy applies when you are using our Services globally. If you are using our Services from a country outside the United States, you acknowledge and agree that your personal information may be transferred to, stored, and processed in the United States, and is subject to the laws of the United States. You acknowledge that the United States may have data protection laws less stringent than or otherwise different from the laws in effect in the country in which you are located. Where we transfer your personal information out of the country in which you are located, we will take steps to ensure that your personal information receives an adequate level of protection where it is processed, and your rights continue to be protected.
11. Changes to this Privacy Policy
The Company will occasionally update this Privacy Policy. When we make changes, we will post the updated Privacy Policy here and will revise the effective date at the top of this agreement. We recommend that you check our website from time to time to inform yourself of any changes to the Privacy Policy.
